A Perfect Zero
Scoring a Perfect Zero
On April 6, 2009, Jampol, Zimet, Skane & Wilcox (JZSW) obtained a defense verdict in a multi-million dollar construction defect case in Orange County, California, utilizing Paradigm Construction Services as the expert witness. The case involved a homeowner, general contractor, architect and ten subcontractors. JZSW’s client, Antis Roofing & Waterproofing, was the “targeted” subcontractor that performed the roofing and waterproofing work at the custom residential project. The alleged defects against the subcontractor focused on defective roof work and water intrusion at the decks. In his closing argument, the plaintiff asked for $1 million in damages, allocating the largest percentage to our targeted subcontractor.
Limited Access
Despite the limited access to the site for investigation––due to the homeowners multiple attempts to refuse access––Paradigm conducted diligent research of the case documentation and was able to successfully identify the primary cause of water intrusion.
Educating the Jury
Taking this information, Liz Skane of JZSW, utilized Paradigm to educate the jury. Through a slide presentation with meticulous and in-depth details, Frank Burton, a principal of Paradigm, communicated to the jury the structural issues and the careless work performed by other trades that resulted in the water intrusion. By educating the jury in this way, Skane & Burton were able to take the target off of Antis Roofing, and direct it elsewhere.

Extensive construction knowledge, combined with dedicated research and field experience, accompanied with excellent communication, produced an amazing result. After an exhausting twelve (12) week trial, the jury attributed ZERO LIABILITY to Antis Roofing & Waterproofing regarding its work. JZSW and Paradigm got their client a rare yet well-deserved defense verdict.
